Farshchian v. Spencer - settlement amount

Total award: $12,500 for pain and suffering.

The Judge determined that Farshchian suffered from soft tissue and ligament injuries, particularly to the neck and back with complaints of pain, discomfort and disability and was not fully recovered within six months of the date of the accident. It was apparent that differences arose between Farshchian and his family doctor during the course of treatment. Because Farshchian went to a chiropractor for treatment, it was reasonable to infer that he needed relief from his complaints for an additional period of time.

However, the Judge was not satisfied that Farshchian's complaints at the time of trial were entirely attributable to the motor vehicle accident. In that regard, the Judge found that the medical management of Farshchian's case left much to be desired, and that Farshchian had to accept some of the responsibility for that.
