This amount was awarded for her pain and suffering as well as two days lost income and her proven out-of-pocket expenses.  The court noted that the defendant was not responsible for symptoms beyond January 2003.   This was based on the lack of objective evidence of injuries beyond this point.  The evidence that showed ongoing problems beyond this point was based on Ms. Kenny’s subjective complaints, not on an examination by her doctors.  The court further found that the claim for loss of earning capacity was speculative and that it fully expected her to recover.  As a result, no amount was awarded under this heading.
