Why might an ICBC claims adjuster ask for access to personal information?

If you have been injured in a motor vehicle accident and are making a claim, the ICBC claims adjuster will ask for authorization to obtain your medical and employment information. You are obligated according to the ICBC regulations to provide ICBC with a medical certificate or report about the nature and extent of your injury. ICBC is also entitled to obtain a medical certificate or report directly from your doctor setting out the injuries you suffered in the accident, and a Certificate of Earnings from your employer. In practice, ICBC usually obtains a medical report from your doctor using the medical authorization you have signed. The form authorizing ICBC to contact your medical practitioners and authorize the release of medical records and reports is a called a "CL237A." In addition, your doctor is obligated to provide a report if ICBC requests it according to Section 28 of the Insurance (Motor Vehicle) Act. The Insurance (Motor Vehicle) Act and the Regulations passed under that Act are the legislative rules under which ICBC operates.

Like your doctor, an employer is obligated to provide wage loss information to ICBC according to Section 29 of the Insurance (Motor Vehicle) Act. The form authorizing ICBC to contact your employer is called a "CL237." Be sure to get a copy of any authorizations you sign and stipulate that you are to be provided with a copy of any records pertaining to your accident.
