What is the Insurance Benefits Application?
Every person injured in a motor vehicle accident in British Columbia, whether responsible for that car accident or not, may be entitled to No Fault Benefits, often referred to as "Part 7 Benefits" or "Accident Benefits." The application for these benefits must be completed and filed with ICBC within 90 days of the car accident if you decide to make an insurance claim. In some cases, an adjuster will assist you in completing the form. Ensure that all the information contained in the form is accurate before you sign it.
No Fault Benefits will not be paid by ICBC unless the insurer is satisfied that you are totally disabled as a result of the injuries you sustained in the car accident. If ICBC does not have any or sufficient information to determine whether you are totally disabled it has the right to send you to a doctor of its choice for the purposes of examining you and providing a report to ICBC. That report will typically address whether you are disabled, how long you are likely to remain disabled and what steps you should take to aid your recovery. |
