What's not covered by the basic "No Fault Benefits"?

There are other expenses that you may incur as a result of being injured in a car accident in British Columbia that are not covered under "No Fault Benefits." Examples would include income loss benefits of more than $300 per week, user fees associated with treatment ,and medical or rehabilitation expenses not approved by ICBC's medical advisors. If the accident was your fault, you won't get any other benefits from ICBC other than those set out in the basic Accident Benefits.

Special Damages

If the accident was not your fault however, you should also be reimbursed for all of the expenses you reasonably and necessarily incurred as a result of your injuries. Lawyers and adjusters call these expenses "Special Damages." Therefore, it is important to keep copies of receipts for all expenses relating to your injuries. Some of the expenses you can later claim in the settlement of your overall claim include:

  • Fees for massage therapy
  • Homemaker and child care expenses you incurred above your basic Accident Benefits provided under Part 7
  • Counseling and retraining expenses if you must retrain for a new occupation
  • The cost of traveling to and from and parking for your treatment
  • Nursing care, if required
  • Taxi fares if your doctor advises you not to drive
  • Some compensation for family members who provide a substantial amount of assistance to you if they keep track of their time and the services they provided
  • Fees for treatment your doctor recommended but that ICBC refused to pay
  • Other reasonable expenses you incurred or will require in the future as a result of your accident
  • Replacement eyeglasses
  • Replacement of torn clothes.
